Welcome to Leva Sleep. These Terms of Service ("Terms") govern your use of the website located at www.levasleepusa.com (the "Site") and your purchase of products from Leva Sleep ("Leva Sleep," "we," "us," or "our"). By accessing the Site, submitting an inquiry, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site.

1. Eligibility

The Site is intended for use by individuals who are at least 18 years of age and located in the United States. By using the Site, you represent that you meet these requirements.

2. Products, Pricing, and Availability

We work to ensure that product descriptions, images, specifications, and prices on the Site are accurate, but errors can occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after an order has been submitted. Promotional pricing is valid only for the period stated and may not be combined with other offers unless expressly noted. All prices are in U.S. dollars. Product availability is not guaranteed, and we may limit quantities at our discretion.

3. Orders and Payment

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by Leva Sleep, and we may refuse or cancel any order for any reason, including suspected fraud or pricing errors. If we cancel an order after your payment has been processed, we will issue a refund to your original payment method. You represent that you are authorized to use the payment method provided and that the billing information you supply is accurate.

4. Financing

Financing options offered at checkout, including promotional financing, are provided by third-party lenders such as Synchrony Bank and are subject to the lender's credit approval, terms, and conditions. Leva Sleep does not originate, arrange, or guarantee credit, and is not a party to any financing agreement between you and the lender. Questions about financing terms, billing, or your account should be directed to the lender.

5. Shipping and Delivery

Shipping methods, delivery timelines, and any delivery services (such as in-home setup or removal) are described on our Shipping & Returns page and at checkout. Delivery dates are estimates and are not guaranteed. Risk of loss passes to you upon delivery. Please inspect your delivery and report any damage to us promptly.

6. Sleep Trial, Returns, and Exchanges

Eligible mattresses come with our sleep trial as described on the Site at the time of purchase. Trial eligibility, break-in requirements, condition requirements, exclusions (such as clearance items, floor models, and certain accessories or special orders), and any applicable fees are described on our Shipping & Returns page. The sleep trial applies only to products expressly identified as trial-eligible, and is limited to one trial per customer per order unless otherwise stated.

7. Warranties

Products sold by Leva Sleep may be covered by a manufacturer's warranty. Warranty terms, durations, and claim procedures vary by manufacturer and product. Except as expressly stated in a written warranty, and to the fullest extent permitted by law, products are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow limitations on implied warranties, so the above limitation may not apply to you.

8. Text Messaging (SMS) Program

Program name: Leva Sleep.

If you provide your phone number and consent to receive text messages — for example, by checking the consent box on one of our web or lead forms — you agree to receive automated follow-up and reminder text messages from Leva Sleep about your inquiry, such as your personalized sleep recommendation, appointment and call reminders, and responses to your questions.

• Message frequency varies based on your interaction with us.
• Message and data rates may apply. Contact your wireless carrier for details about your plan.
• Opt out at any time by replying STOP to any message. After you opt out, you will receive one final message confirming your opt-out. Reply HELP for help, or contact us using the information below.
• Consent is not a condition of purchase.
• Mobile information and text messaging opt-in data will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details on how we handle your information.
• Carriers are not liable for delayed or undelivered messages.

9. Use of the Site

You agree to use the Site only for lawful purposes. All content on the Site — including text, images, logos, product names, graphics, and site design — is the property of Leva Sleep or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent.

11. Third-Party Links and Services

The Site may contain links to third-party websites or services (including payment and financing providers). We are not responsible for the content, policies, or practices of third parties, and a link does not imply our endorsement. Your use of third-party services is at your own risk and subject to their terms.

12. Limitation of Liability

To the fullest extent permitted by law, Leva Sleep and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or purchase of products, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim arising out of these Terms or your purchase will not exceed the amount you paid for the product giving rise to the claim. Some states do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Leva Sleep from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site.

These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the state in which Leva Sleep is organized, without regard to conflict-of-law principles, and applicable federal law.

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Changes take effect when posted to the Site, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
